BY CLICKING "I AGREE", INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY
THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.
Section 1 — Definitions
1.1 "Agreement" means this End User License Agreement and Terms & Conditions, including any amendments published by DecoSoap BV from time to time.
1.2 "Software" means the TCI Remote Compactor application, including all associated files, documentation, updates, patches, and supplementary components provided as part of the licensed package.
1.3 "DecoSoap BV" means DecoSoap BV (VAT BE0457088150), a company registered under Belgian law, the developer and exclusive licensor of the Software.
1.4 "You" / "Licensee" means the individual who has purchased a valid license key and who accepts this Agreement.
1.5 "License Key" means the unique alphanumeric key issued to the Licensee upon purchase, which activates the Software.
1.6 "Callsign" means the amateur radio callsign registered by the Licensee with their national telecommunications authority and provided at the time of purchase.
1.7 "Station" means a single, fixed or portable amateur radio installation operated by the Licensee under their personal Callsign.
1.8 "Device" means a single physical computer (desktop, laptop, or equivalent) on which the Software is installed and used.
1.9 "Tunnel Service" means the trycloudflare.com service provided by Cloudflare, Inc., used by the Zero-Config remote access feature of the Software.
1.10 "Zero-Config Feature" means the optional remote access functionality within the Software that relies on the Tunnel Service to establish a connection between the Licensee's Station and a remote client.
1.11 "Third-Party Services" means any service, platform, or infrastructure not owned or operated by DecoSoap BV, including but not limited to Cloudflare, Inc. (tunnel service), Gumroad, Inc. (payment and license validation), and Discord, Inc. (support channel).
1.12 "Controlled Equipment" means any hardware device commanded, monitored, or otherwise interacted with through the Software, including but not limited to software-defined radio transceivers, amplifiers, antenna tuners, rotators, power supplies, and any other amateur radio or electronic equipment.
1.13 "License Term" means the period of two (2) years beginning on the date of purchase, during which the Licensee is entitled to updates and support as described in Section 3.
Section 2 — Grant of License
2.1 Scope. Subject to the terms of this Agreement and payment of the applicable license fee, DecoSoap BV grants the Licensee a limited, personal, non-exclusive, non-transferable, non-sublicensable license to install and use one (1) copy of the Software on one (1) Device at one (1) Station.
2.2 Single User. The license is granted to a single individual. The Software may not be used simultaneously or successively by multiple persons under the same License Key.
2.3 Single Device. Installation of the Software on more than one Device is strictly prohibited. If the Licensee replaces their Device, they must uninstall the Software from the previous Device before installing it on the new Device. DecoSoap BV reserves the right to enforce this restriction technically through license server validation.
2.4 Single Station. The Software may only be used to control equipment at the Licensee's own Station, operated under the Licensee's own Callsign. Use of the Software to control another operator's equipment or under another operator's callsign is not permitted.
2.5 No Transfer. The License Key, license, or any rights under this Agreement may not be transferred, sold, rented, leased, lent, or otherwise conveyed to any third party. Any attempted transfer is void and constitutes a material breach of this Agreement.
2.6 Reservation of Rights. DecoSoap BV reserves all rights not expressly granted in this Agreement. The Software is licensed, not sold.
Section 3 — License Term and Version Scope
3.1 Duration. The license is valid for a period of two (2) years from the date of purchase. After expiry of this two-year period, the Software will continue to function; however, DecoSoap BV's obligation to provide updates, patches, bug fixes, or support shall cease entirely.
3.2 Version Scope. This license covers version 1.X of the Software only — that is, all releases carrying a major version number of 1 (e.g. v1.0, v1.1, v1.2). If DecoSoap BV releases version 2.0 or any subsequent major version, a new and separate license key will be required. An existing license does not entitle the Licensee to any major version upgrade.
3.3 No Automatic Renewal. This Agreement does not renew automatically. After the two-year period, the Licensee may continue using their installed version without purchasing a new license, subject to Section 3.2. No further updates or support will be provided.
3.4 End of Support. Upon expiry of the License Term, DecoSoap BV has no obligation to provide security patches, compatibility fixes, bug fixes, or technical support. Continued use of the Software after expiry of the License Term is entirely at the Licensee's own risk.
3.5 No Refund Upon Expiry. Expiry of the License Term does not entitle the Licensee to any refund, credit, or compensation of any kind.
3.6 Termination for Breach. If this Agreement is terminated by DecoSoap BV due to a Licensee breach (see Section 12), the license is revoked immediately and the Software may cease to function. No refund shall be issued.
Section 4 — No Refund Policy
4.1 Digital Product. The Software is a digital product delivered electronically. By completing the purchase, the Licensee acknowledges and agrees that they have expressly requested immediate access to the digital content and that, as a result, they waive their statutory 14-day right of withdrawal as permitted under EU Directive 2011/83/EU and its transposition into Belgian law, because the digital content is made available immediately upon purchase.
4.2 All Sales Final. All purchases of the Software are final. DecoSoap BV does not offer refunds, exchanges, or credits under any circumstances, except where expressly required by applicable mandatory law.
4.3 Conformity Caveat. Nothing in this Section shall be construed to exclude rights the Licensee may have under EU Directive 2019/770 on digital content contracts in the event the Software is fundamentally not in conformity with what was described at the time of purchase and DecoSoap BV has failed to remedy such non-conformity within a reasonable time.
4.4 Chargebacks. Initiating an unjustified chargeback or payment dispute with the payment processor constitutes a material breach of this Agreement and will result in immediate license revocation.
Section 5 — Restrictions
The Licensee shall not:
- copy, reproduce, or duplicate the Software, except as reasonably necessary for backup purposes;
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except to the extent permitted by applicable mandatory law;
- modify, adapt, translate, or create derivative works based on the Software;
- remove, alter, or obscure any copyright, trademark, or other proprietary notices within the Software;
- use the Software for any unlawful purpose or in violation of applicable regulations, including amateur radio licensing laws;
- share, publish, distribute, or make the Software available to any third party;
- use the Software to control equipment the Licensee is not legally authorized to operate;
- circumvent, disable, or interfere with any license enforcement, authentication, or security mechanism within the Software;
- use the Software in any manner that could damage, disable, overburden, or impair the servers or networks used by DecoSoap BV or any Third-Party Service.
Section 6 — Hardware Liability Disclaimer
6.1 Acknowledgement of Risk. The Licensee expressly acknowledges that the Software transmits commands over a network to Controlled Equipment, including radio transceivers, power amplifiers, antenna tuners, and rotators. Such remote command of hardware carries inherent risks including unintended equipment activation, misconfiguration, transmission in prohibited frequency bands, and hardware damage.
6.2 Full User Responsibility. The use of the Software and any resulting operation of Controlled Equipment is entirely at the risk and sole responsibility of the Licensee. The Licensee is solely responsible for ensuring that all Controlled Equipment is operated in compliance with applicable laws, regulations, and their amateur radio license.
6.3 No Liability for Hardware Damage. DecoSoap BV shall not be liable for any damage to, failure of, or malfunction of any Controlled Equipment or other hardware arising from the use or misuse of the Software, whether caused by a defect in the Software, incorrect configuration, network interruption, or any other cause.
6.4 No Liability for Interference. DecoSoap BV shall not be liable for any radio frequency interference, unauthorized transmissions, regulatory violations, or penalties arising from the use of the Software.
6.5 Third-Party Hardware Warranties. Nothing in this Agreement affects the Licensee's rights under any warranty provided by the manufacturer of their Controlled Equipment.
Section 7 — Tunnel Service Disclaimer
7.1 Third-Party Service. The Zero-Config Feature relies on the trycloudflare.com tunnel service operated by Cloudflare, Inc., a company independent of and unaffiliated with DecoSoap BV.
7.2 Free Service. The trycloudflare.com tunnel service is provided by Cloudflare, Inc. free of charge and without a service level agreement. Its availability, reliability, performance, and continued existence are entirely at Cloudflare's discretion.
7.3 No Liability for Tunnel Availability. DecoSoap BV shall not be liable for any interruption, degradation, unavailability, or termination of the Tunnel Service, regardless of cause. This includes, without limitation, downtime, rate-limiting, IP blocking, service changes, or discontinuation of the trycloudflare.com service by Cloudflare, Inc.
7.4 Compatibility Efforts. DecoSoap BV will make reasonable efforts to update the Software to maintain compatibility with the Tunnel Service in the event of changes made by Cloudflare, Inc. However, such efforts are made on a best-effort basis and do not constitute a guarantee of continued functionality.
7.5 Security of Tunnel. The Tunnel Service establishes an encrypted connection between the Licensee's Station and remote clients. DecoSoap BV does not control the encryption standards, security infrastructure, or data handling practices of Cloudflare, Inc. The Licensee assumes all risk associated with transmitting data through Third-Party Services.
7.6 PIN Security. The Licensee is solely responsible for keeping their PIN confidential. DecoSoap BV shall not be liable for unauthorized access to the Licensee's Station resulting from disclosure, loss, or compromise of the PIN.
Section 8 — General Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DECOSOAP BV EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
8.2 DecoSoap BV does not warrant that the Software will operate without interruption, error, or defect, that defects will be corrected, or that the Software is free from viruses or other harmful components.
8.3 DecoSoap BV does not warrant that the Software will be compatible with any particular hardware, operating system, radio transceiver, firmware version, or third-party software, including but not limited to ExpertSDR and any TCI protocol implementation.
8.4 DecoSoap BV does not warrant that use of the Software will comply with the amateur radio regulations of the Licensee's jurisdiction. The Licensee is solely responsible for regulatory compliance.
Section 9 — Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DECOSOAP BV, ITS DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF REVENUE, LOSS OF GOODWILL, BUSINESS INTERRUPTION, EQUIPMENT DAMAGE, COST OF REPLACEMENT GOODS, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF DECOSOAP BV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.2 Aggregate Liability Cap. To the maximum extent permitted by applicable law, DecoSoap BV's total aggregate liability to the Licensee for all claims arising out of or relating to this Agreement shall not exceed the amount actually paid by the Licensee for the License Key.
9.3 Essential Basis. The Licensee acknowledges that the limitations of liability in this Section reflect a reasonable and fair allocation of risk between the parties and are an essential basis of the bargain. DecoSoap BV would not have provided the Software at the offered price without these limitations.
9.4 Mandatory Law. Nothing in this Agreement shall limit or exclude liability which cannot be excluded or limited under applicable mandatory Belgian or EU law.
Section 10 — Support
10.2 No Other Support Channels. DecoSoap BV does not provide support via email, telephone, social media, or any other channel. Requests submitted outside the designated Discord channel cannot be guaranteed a response.
10.3 Best-Effort Basis. Support is provided on a voluntary, best-effort basis. DecoSoap BV makes no commitment regarding response times, resolution of issues, or availability of support personnel.
10.4 Scope of Support. Support is limited to reasonable assistance with the use of the Software as described in its documentation. DecoSoap BV is not obligated to provide support for: third-party hardware configuration, operating system issues, network configuration unrelated to the Software, issues caused by modifications to the Software by the Licensee, or issues arising from incompatibilities with unsupported software.
10.5 Support During License Term Only. DecoSoap BV's obligation to provide support expires at the end of the two-year License Term as described in Section 3.
10.6 Discord Terms. Use of the Discord support channel is subject to Discord's own Terms of Service. DecoSoap BV is not responsible for the availability or operation of Discord's platform.
Section 11 — Privacy and Data
11.1 Data Collected. The Software collects and transmits the following data to DecoSoap BV's servers: the Licensee's amateur radio Callsign, a hashed (non-reversible) representation of the License Key, and the public IP address associated with tunnel registration. No other personal data is transmitted to DecoSoap BV by the Software itself. Clauses 11.6 to 11.9 describe audio which the Software may send directly to a third-party artificial intelligence service, on the Licensee's own account and at the Licensee's own initiative; that audio does not pass through DecoSoap BV's servers, and DecoSoap BV neither receives nor stores it.
11.2 Purpose. The data described in Section 11.1 is collected solely for the purpose of enabling the Zero-Config remote access feature and enforcing the terms of this license.
11.3 Retention. Data is retained for the duration of the License Term and for a reasonable period thereafter for audit and fraud prevention purposes.
11.4 Third-Party Processors. License key validation is processed by Gumroad, Inc. Payment data is handled exclusively by Gumroad, Inc. DecoSoap BV does not receive or store payment card information. The Licensee's use of the Gumroad platform is subject to Gumroad's own Privacy Policy and Terms of Service. For the artificial intelligence service used by the optional voice features, see Clauses 11.6 to 11.9.
11.5 No Sale of Data. DecoSoap BV does not sell, rent, or share the Licensee's personal data with third parties, except as required by applicable law or as necessary to provide the services described in this Agreement.
11.6 AI Voice Features. The Software contains two optional features which send audio to an artificial intelligence service operated by Google LLC: Live Translate, which sends the Licensee's own transmitted speech in order to return a translated voice, and RX Transcript, which sends received speech in order to return a written transcript and translation. Both features are switched off by default, and neither can operate until the Licensee has obtained a Google Gemini API key of their own and entered it in the Software. Enabling either feature is a deliberate act of the Licensee.
11.7 Direct Transmission; No Access by DecoSoap BV. Audio processed by the features described in Clause 11.6 is transmitted directly from the Licensee's Device to Google's servers over an encrypted connection, and is charged to the Licensee's own Google account. It does not pass through, and is not copied to, any server operated by DecoSoap BV. DecoSoap BV does not receive, store, process, or have any means of access to that audio, to the transcripts produced from it, or to the Licensee's API key, which is held only in the Software's local configuration file on the Licensee's own Device. The Software does not write this audio to disk. In the terminology of Regulation (EU) 2016/679 (GDPR), the Licensee acts as the controller in respect of this processing; DecoSoap BV is neither controller nor processor of it.
11.8 Speech of Third Parties. The Licensee acknowledges that RX Transcript, by its nature, processes the speech of other stations, who are not parties to this Agreement and who may be unaware that their transmissions are being transcribed or translated. The Licensee is solely responsible for ensuring that their use of this feature is lawful in their jurisdiction, including any national rules on the recording, retention, disclosure, or retransmission of radio communications, any conditions attached to their amateur radio licence, and any obligation to inform the stations they are working. DecoSoap BV provides no legal advice on this point and makes no representation that the feature is lawful in any particular jurisdiction. The Licensee shall indemnify and hold DecoSoap BV harmless against any claim brought by a third party arising out of the Licensee's use of the features described in Clause 11.6.
11.9 Google's Terms Apply. The Licensee's use of the features described in Clause 11.6 is subject to the terms of service and privacy policy applicable to their own Google account and API key. Whether, for how long, and for what purposes Google retains or uses the audio and the transcripts is determined by those terms and not by this Agreement. The terms applicable to free and paid Google API tiers differ, in particular as regards whether submitted content may be used to improve Google's services. The Licensee is advised to read them before enabling either feature.
Section 12 — Termination
12.1 Termination by DecoSoap BV. DecoSoap BV may terminate this Agreement immediately and without notice if the Licensee:
- violates any term of this Agreement;
- provides a false, invalid, or third-party Callsign;
- transfers or attempts to transfer the License Key or license to another person;
- installs the Software on more than one Device simultaneously;
- initiates an unjustified chargeback or payment dispute;
- engages in conduct that DecoSoap BV determines constitutes abuse of the callsign change system or the Zero-Config Feature.
12.2 Effect of Termination. Upon termination, all rights granted under this Agreement cease immediately. The Licensee must immediately stop using the Software. No refund shall be issued upon termination due to breach.
12.3 Survival. Sections 6, 7, 8, 9, and 13 shall survive termination or expiry of this Agreement.
Section 13 — Governing Law and Dispute Resolution
13.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.
13.2 Jurisdiction. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Belgium.
13.3 Informal Resolution. Before initiating any formal legal proceedings, the Licensee agrees to first contact DecoSoap BV through the support channel described in Section 10 and allow thirty (30) days to attempt informal resolution.
Section 14 — Intellectual Property
14.1 Ownership. The Software, including all source code, object code, interfaces, documentation, and all other components, is the exclusive intellectual property of DecoSoap BV and is protected by Belgian and international copyright law, as codified in Book XI of the Belgian Code of Economic Law (Wetboek Economisch Recht).
14.2 No Rights Conferred. Nothing in this Agreement shall be construed as conferring upon the Licensee any rights in the trademarks, trade names, logos, or other intellectual property of DecoSoap BV, beyond the limited right to use the Software as expressly set out herein.
Section 15 — Force Majeure
15.1 DecoSoap BV shall not be liable for any failure or delay in performing its obligations under this Agreement to the extent caused by circumstances beyond DecoSoap BV's reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government action, power failures, internet outages, cyberattacks, failure of third-party services (including Cloudflare or Gumroad), or changes in applicable law or regulation.
Section 16 — Callsign Integrity and Amateur Radio Compliance
16.1 Valid Callsign Required. The Licensee must register the Software using their own valid, currently licensed amateur radio callsign. Registration using a false, expired, third-party, or otherwise invalid callsign is a material breach of this Agreement.
16.2 Regulatory Compliance. The Licensee is solely responsible for complying with all amateur radio regulations applicable in their jurisdiction, including transmit power limits, band plans, license class restrictions, identification requirements, and prohibited transmissions. DecoSoap BV assumes no responsibility for ensuring such compliance.
16.3 Callsign Changes. The Licensee may request a change of registered Callsign up to two (2) times per calendar month. All callsign changes are logged and subject to manual review. Callsign changes may not be used to transfer a license to another individual. DecoSoap BV reserves the right to refuse or reverse a callsign change if fraud is suspected.
Section 17 — Amendments
17.1 DecoSoap BV reserves the right to modify this Agreement at any time. The current version will be made available on the DecoSoap BV website and within the Software. Continued use of the Software after publication of an updated Agreement constitutes acceptance of the revised terms.
Section 18 — Severability
18.1 If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if not possible, severed from this Agreement, without affecting the validity and enforceability of the remaining provisions.
Section 19 — Entire Agreement
19.1 This Agreement constitutes the entire agreement between the Licensee and DecoSoap BV with respect to the Software and supersedes all prior understandings, proposals, representations, or agreements, whether written or oral, relating to the subject matter hereof.
19.2 No waiver of any term of this Agreement shall be effective unless made in writing and signed by an authorized representative of DecoSoap BV.
